2. Purpose and acceptance

These Terms & Conditions of Sale (the “Terms”) govern the sale of products offered on the Site to consumers. Placing an order implies full and unreserved acceptance of these Terms, which prevail over any other document. sheWim® reserves the right to amend them at any time; the Terms applicable are those in force on the date the order is placed.

3. Products

Our products are cosmetic devices and skincare products for at-home, non-medical use. Descriptions, photographs and claims relate to the appearance of the skin and do not constitute medical advice. Results may vary from one individual to another. Please read the usage instructions and precautions provided with each product.

4. Prices

Prices are shown in euros (€), inclusive of applicable taxes where relevant, and exclusive of delivery charges and of any customs duties or import taxes that may apply outside the European Union (see our Shipping Policy). sheWim® reserves the right to change its prices at any time; the price applicable is the one displayed at the time of the order.

5. Orders

The customer selects the products, adds them to the cart, reviews the order summary and confirms it. The sale is final once the order confirmation is sent by email. sheWim® reserves the right to refuse or cancel any order in the event of a manifest pricing error, suspected fraud, or stock unavailability.

6. Payment

Payment is made online at the time of the order, by the means offered on the Site (credit/debit card, Apple Pay, Google Pay, PayPal, etc.). Transactions are secured by our payment providers. Orders are processed once payment is confirmed.

7. Delivery

Delivery terms, times and costs are set out in our Shipping Policy. Delivery times are estimates given after dispatch. sheWim® cannot be held liable for delays caused by the carrier, customs, or circumstances beyond its control.

8. Right of withdrawal

As a goodwill commercial policy, you have 30 days from receipt of your order to request a return (the statutory withdrawal period for consumers in the European Union being 14 days). To exercise this right, contact us at customerservice@shewim.com.

For hygiene and health-protection reasons, skincare products (creams, serums, ampoules, sheet masks) that have been unsealed cannot be returned. Devices must be returned unused, complete and in their original packaging.

9. Returns and refunds

The procedure, conditions and refund times are detailed in our Returns & Refunds policy. Return shipping costs are borne by the customer, except where the product is defective or an error occurred on our part.

10. Legal guarantee

Products benefit from the legal guarantees applicable in the customer’s country of residence, including, for consumers in the European Union, the legal guarantee of conformity. Devices are additionally covered by a 1-year manufacturer warranty against manufacturing defects, excluding normal wear, misuse, or damage caused by failure to follow the instructions.

11. Liability

sheWim® products are intended for cosmetic use only and do not replace any medical treatment. sheWim® cannot be held liable for any misuse of the products or use contrary to the instructions and precautions provided. Our liability may not exceed the amount of the order concerned.

12. Intellectual property

All elements of the Site (brand, logos, texts, images, videos) are the exclusive property of sheWim® or its partners and are protected by intellectual property law. Any reproduction or use without prior authorisation is prohibited.

13. Personal data

Personal data collected is processed in accordance with our Privacy Policy. You have rights of access, rectification and erasure of your data, which you may exercise at customerservice@shewim.com.

14. Governing law and disputes

In the event of a dispute, the customer is invited to contact us first at customerservice@shewim.com to seek an amicable solution. Consumers resident in the European Union may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. Mandatory consumer-protection provisions of the customer’s country of habitual residence remain applicable.
